0. Applicability

0.1. These general terms and conditions apply to all quotations, work, assignments and agreements of Baarn Services (hereinafter: “Contractor”).

0.2. The other party is referred to as “Client”.

0.3. Deviations from these terms and conditions are only valid if agreed upon in writing.

0.4. The Client's General Terms and Conditions are expressly rejected.

1. Activities

1.1. The Contractor performs various activities, including but not limited to:

• complete renovation works
• plumbing
• tiling
• plasterwork
• caulking
• electrical work
• extension and renovation
• carpentry
• finishing and installation work

1.2. All work is performed to the best of our knowledge and craftsmanship.

2. Quotations and agreement

2.1. Quotations are non-binding and valid for 30 days, unless otherwise stated.

2.2. An agreement is concluded upon written or digital (for example, WhatsApp or email) confirmation of consent.

2.3. Changes to the assignment may affect price and schedule.

3. Execution of the work

3.1. The Client shall provide for:

• free access to the workplace
• presence of water and electricity
• a safe working environment

3.2. If these facilities are missing, the Contractor may postpone work and charge costs.

3.3. Additional work will be carried out after approval by the Client and will be invoiced separately.

4. Payment

4.1. Payment arrangement:

• 40% down payment upon agreement
• 50% during the work
• 10% upon delivery (within 3 days)

4.2. In the event of late payment, the Client shall be in default by operation of law.

4.3. The Contractor has the right to suspend work in the event of non-payment.

5. Cancellation

5.1. Cancellation must be made in writing or by email.

5.2. In the event of cancellation within 24 hours prior to the scheduled start, or if the Contractor can start immediately but the Client cancels:

• is becoming €240 per person per day charged.

5.3. Costs already incurred and materials purchased are always passed on.

6. Warranty

6.1. Warranty is only provided if explicitly stated in the quotation.

6.2. A manufacturer's warranty applies to third-party materials.

6.3. Warranty expires in the event of:

• incorrect use
• insufficient maintenance
• work by third parties

7. Liability

7.1. The Contractor is solely liable for direct damage.

7.2. Liability is limited to the invoice amount of the assignment.

7.3. The Contractor is not liable for indirect damages such as:

• consequential damage
• delay
• loss of profit

7.4. Damage must be reported in writing within 14 days.

8. Force Majeure

8.1. In the event of force majeure (such as illness, weather conditions, material shortages, or external circumstances), the Contractor may suspend or reschedule work without liability.

9. Complaints

9.1. Complaints must be reported in writing within 7 days after delivery.

9.2. Well-founded complaints will be resolved within a reasonable time.

10. Applicable law

10.1. All agreements are governed by Dutch law.

10.2. Disputes shall preferably be resolved by mutual agreement.

10.3. If necessary, disputes shall be submitted to the competent court.
